The following General Business Terms ("Terms") govern your accessing and use of the Application (see below). This application is used by ANI Technology Private Ltd and its affiliates, related parties, licensors and related entities ("ANI"). ANI grants you a revocable licence to use any restricted functionality of the Application and does not sell the Application or any functionality or technology in it.

Disclaimer: This is a recording of information contained in an information technology file within the meaning of the Information Technology Act, 2000 ("IT Act") and its related regulations and the requirements of various laws relating to recording of information in the form of the IT Act. Your continued use of the Application constitutes your agreement to be bound by these TOS.

Before using the application and its functions, please make sure that you are familiar with all of these terms and conditions. In the event that you consider any of the terms and conditions to be inadmissible, do not give your consent to the use of the application and do not use any of its functions. As between you and a third party, your understanding of these T&C is a legal and enforceable understanding between you and a third party with regard to the functionality offered/mediated using the Mobile Application.

Each term you define and activate in these GTCs has the meanings given below: "Carpooling " means the offering and accepting by the Passenger (hereinafter defined) and the Passenger (hereinafter defined) to divide the same vessel for carriage from and to jointly arranged places on the Application.

"Co-Traveller " means the User who has accepted an Passenger's Programme (hereinafter defined) for carriage in his/her vehicle (hereinafter defined) to and from jointly arranged places in the Registration. "A " Custom Group " means a cohesive group of like-minded individuals established by users who undertake to be part of the same group for carpooling reasons.

On the application, the Custom Group is to be named[please insert]. "ETA " means the approximate ETA of the vehicle at the passenger's pick-up point provided by ANI before the journey and which may vary from period to period. "ETT " means the approximate journey duration of the journey as indicated by ANI during the journey, which may vary from period to period.

"The " Open Group " includes those who do not wish to run a carpooling programme within a user-defined group and are willing to be grouped together and who will be grouped together by the ANI for the purpose of carpooling with other similar members. "Trip " means the trip to and from the jointly arranged places on request, through and between the traveller and the passenger.

"Traveler " is the person who proposes to offer to share his/her car with other users in order to facilitate transport to and from commonly arranged places in the application. "Users " are people who have set up an account and are using the application. "motor vehicle" means a motor car as referred to in the Motor Vehicles Act 1988, which is in the possession of and recorded in the name of the passenger.

"You", "your" or "yourself" means the notice to the user who accesses the Application. Headlines and picture titles serve only for clarity and have no influence on the layout of the GTC. If you are "authorized" to use the Application, you must meet all of the following conditions: Only if you meet the requirements set out in 3.1 may you use the Service on the Application.

Please refrain from any attempt to enroll or use the application if you are not authorized to do so. Your continued use of the Application constitutes and warrants to the ANI that you will meet the admission requirements set out in Term 3.1 above. In order to use the application, you must maintain your Username and Password with the information you provided at registration, which may contain, but is not limited to, personally identifiable information and registration and registration information.

Acknowledging that we fully trust the information you provide us with, you understand and agree that we will not be held accountable if you or anyone using your user name and password to gain control of the application is not authorized to use it. The ANI is not responsable for the genuineness of the information provided by the user for the use of the application.

We do not allow you to pose as anyone else or give us bank information, an e-mail addressee, a cell phone number, car data or other information that is not your own. You are responsible for checking and ensuring that you are downloading the proper application for your equipment. If you do not have a compliant wireless unit, if you have not down-loaded the upgraded copy, or if you have down-loaded an incorrect copy of the application for your wireless unit, we will not be responsible.

Traveller can volunteer to divide his car with other users on the application and traveller shares for this reason his point of departure and point of arrival for the trip. A passenger may make an application for a passenger in the declaration by indicating his place of departure and place of arrival for the requested journey.

This application is intended to link travelers and co-travelers with shared or narrow points of departure and arrival for a journey by means of technological automation. The ANI shares the necessary data of the Passenger and the Passenger with the other Contracting Parties linked by the application and the Passenger has the possibility to accept or reject the Passenger's proposal for the journey between the requested points of departure and arrival until the journey begins.

No more than one co-traveller may travel with a traveller in the same journey. Application is restricted solely to facilitate the joint use of vehicles between passengers and fellow passengers for one journey. On no account may the application be used to provide or receive carpooling service for industrial or professional use or gain or for a trade or profession advantage.

This application is just a communications plattform designed to link travelers with fellow travelers on their way to their destinations. They may not provide any service, whether or not limited to parcel delivery, extra departures and pick-ups from other persons on the way to the final point or at any other point during the journey. The only way you can make a carpooling enquiry is through the application.

The user understands and agrees that the use of the application is for his use only. Travellers must make sure that: they keep their vehicles in good working order and are not under the effect of alcoholic beverages or other narcotics at the moment of applying for a carpool. They must endeavour to reach the co-traveller's pick-up point on or in front of the ETA and must also endeavour to remove the co-traveller from their place of arrival on or in front of the ETT. They must comply with all current road regulations at all times during the journey.

Passengers shall make sure that the vehicles allocated to them in the way specified in the General Terms and Conditions bear the same licence plate and the identification information provided to them by the application and/or SMS. Female users are recommended to use their own diligence when providing or receiving a ride on the application, as ANI cannot warrant the integrity of information provided by other users.

Female passengers are encouraged to divide the journey information with either their families, acquaintances, relatives or any other persons they consider suitable. This application contains the necessary functions for these passengers to communicate the detail of their journey. Acknowledging that the information you provide in the Application, includes site information, may be available to certain other Application Users.

We hereby explicitly agree to receiving notices from us via your telephone number and/or e-mail address. It is your sole responsibility to maintain the privacy of your registration information and you are accountable for all activity and transaction that occurs through your registration and application, whether it has been initiated by you or a third person.

Do not examine, scan, or test the Application weakness or a weak point in a linked application or application related networks, and do not violate the application or application related networks safety or authentification procedures. No information about another user of the Application or another ANI client, even an ANI client not belonging to you, may be traced, traced or attempted to be traced back to its original origin, or the Application or any service or service or information provided or provided through the Application may be used in any way by you for the purposes of disclosing information, which includes, but is not restricted to, personally identifiable information or information that is not your own information, as provided in the Application.

Do not use the Application in any way that could corrupt, disable, overload, block, or compromise the servers associated with the Application.

They may not try to obtain unauthorised use of the Service through any means such as hacking, passwords harvesting or otherwise. Re-develop, de-compile and de-assemble any piece of code used to make the Service available on the Application. Do not make any statement or comment that is adverse, disparaging or libelous about ANI or the trademark or Internet name used by ANI, or otherwise take any actions or take any steps that could damage the appearance or fame of ANI or its distributors on the Site, or otherwise damage or water down any of the ANI trademarks or service marks, trademarks and/or goodwill associated with such trademarks or service marks, trademarks held by ANI or used by ANI.

Either you may not promote or encourage other users of the Application to buy or resell any product or service, or you may not do so, except for those related to or advertised in connection with the Application. You are in breach of these Terms and Conditions to use any information obtained from the Application to bully, misuse or damage another individual or to otherwise communicate, promote, advertise using, or resell to another individual outside the Application without the express permission of ANIs.

ANI retains the right, in order to safeguard ANI Users from such advertisement or encouragement, to limit the number of communications or e-mails that a User may transmit to other Users within a 24-hour timeframe that ANI, in its absolute judgment, deems appropriate. Either you agree that ANI has the right at any time to release any information (including the identities of those individuals who provide information or material in the Application) to the extent necessary to comply with any laws, regulations or applicable government requests.

ANI (and you hereby explicitly authorise us to do so) may also provide any information about you to criminal prosecution authorities or other federal officers because ANI, in its absolute judgment, considers that this is necessary or appropriate in relation to the investigations and/or solutions of possible criminal offences, in particular those which may result in bodily harm.

You correspond or do business with, or participate in, third parties' promotional activities found on or through the Application, transactions involving the purchase and supply of related goods or related service, and any other term, condition, warranty or representation associated with such transactions are between you and the third parties only.

No liability or responsibility is accepted by us for any losses or losses of any kind arising out of such transactions or the existence of such third parties in the application. It is ANI's right to take all necessary measures and to assert claims for compensation that may arise from your interest in DoS/DDoS (Distributed Denial of Services) in any way, alone or through groups of persons, deliberately or inadvertently.

Use any information provided by us for download from the Application provided that you make no further assurances or warranty with respect to such use. If you change any of our policies or laws, or violate these Terms and Conditions, or for any cause, we may change, discontinue or discontinue the Application at anytime, without previous notification.

Any or all liabilities, whether directly or indirectly, resulting from or related to the journey and/or as a result of abuse of the use, delay incurred by a user, loss (financial or otherwise), injuries or deaths sustained during the journey are the exclusive responsibilities of the user. The ANI is not a contracting partner for any disputes and/or demands that may arise in relation to the trip on offer and asserted by the request.

ANI is only an intermediary and is not involved in any contracts / agreements between and between the users. In addition, ANI shall not be held responsible in any way for any losses incurred by any User or other individual for any reason such as fraud, neglect, imitation, careless and reckless operation, breach of road regulations by any User, and this is the User's exclusive liability.

They shall represent, warrant, indemnify against, and defend ANI, any of its subsidiaries (and their relevant officers, directors, representatives and agents) and any individual designated by ANI from and against all actions, cost, loss, damage, judgement, punishment, interest and expense (including reasonable attorney's fees) resulting from the use or abuse of the application or breach of these Terms and Conditions.

UNDER NO CIRCUMSTANCES SHALL OUR AGGREGATE ACCUMULATED LIABILITIES TO YOU FOR ALL DAMAGES WHATSOEVER RESULTING FROM YOUR USE OF THE APPLICATION, REGARDLESS OF THE CAUSE OF ACTION, EXCEED 1000/- (RUPESS ONE THOUSAND ONLY). With the exception of our restricted roles as a carpooling agent between the traveller and the fellow traveller, we are not engaged in any communication between you and any other user or third party.

The use of the application is at your own peril. This application and/or its functions are provided on an "as is" and "as available" base. No warranty is given, and no representation is made, as to any particular results arising from the use of the Application, whether express or implied, either express or implied, including but not limited to the unavailability or non-availability of the functionality that is part of the Application at any particular place or at any particular point in your life.

The contents of the application represent or are intended to represent a recommendation of any kind; ANI is not answerable or liable for any losses or injuries, whether directly or indirectly incurred or incurred by the user(s), resulting from travel resulting from carpooling, inclusive but not restricted to those resulting from carpooling, whether directly, indirectly, incidentally, punishably or consequentially.

Driving and any resulting claims required by the application are the sole responsability of the user against whom the claims are made, and ANI is not accountable for the behaviour of the user using the application. The ANI is not accountable for the behavior of any user of the application, whether on-line or off-line.

It is your sole responsibility to interact with other users, whether travelers or co-travelers. ANI is not accountable for the actions or inactions of any User. NOTE: ANI and its designees, directors, employees, agents and subcontractors shall not be held to any extent and shall not be held to any party or parties by ANI or any of its designees, directors, servants, directors, employees, subcontractors or assigns to ANI or any of its designees, directors, assignees, agents, subcontractors, directors, employees, affiliates, directors, employees, employees, agents and subcontractors, for any losses, damages, claims, expenses, fees (including reasonable attorneys' fees) or liabilities directly or indirectly resulting from your use or non-use of the Application or your confidence in the information in the Application (whether caused by ANI's or any other person's negligence or otherwise).

All notices or notices you wish to give us in respect of these Terms and Conditions must be in writing: Our general terms and conditions and the data protection guidelines apply to them. No liability will be accepted for non-performance of any obligation under these GTC if service is impeded, obstructed or postponed as a result of an act of God, in which case their obligation will be waived for the duration of the act of God.

If we fail to postpone or refrain from exercising or enforcing any right or provision of these Terms and Conditions, this shall not be construed as a waiver of such right or provision. Every demand in connection with the registration or the general terms and conditions are to be asserted within 3 (three) month after the cause of complaint has arisen. Entitlements submitted after this deadline are excluded.

Subject to our right at any and all times and in our absolute judgment, to make changes to the Terms and Conditions or to the Application Policy or Policy or to the functions associated with the Application. All changes will be effective upon publication of the changes to the request and we may automatically notify you of those changes by emailing you at your own address.

If not otherwise stated by us, changed general terms and conditions shall come into force and shall be obligatory from the date of their publication in the application. Your continued use of or reliance on the Application or its related functions constitutes your agreement to abide by and be bound by these modified Terms and Conditions.

Should you not be in agreement with the changed General Terms and Conditions, you should immediately cease access to our application and/or its functions. For as long as you adhere to these Terms and Conditions, we provide you with a nonexclusive, non-transferable, restricted, individual right to access and use the Application and its related functions. The present General Terms and Condition represent the complete contract between the user and ANI regarding the ANI service and replace all previous or simultaneous messages and offers, whether electronically, verbally or in writing, between the user and ANI regarding this service. Print versions of the T&C and any communication in electronical format shall be permitted in court or administration procedures arising out of or related to the T&C to the same extend and under the same terms and circumstances as other commercial documentation and recordings initially produced and retained in print format.

All disputes, controversies or demands resulting from or in relation to the use of the Application and/or its functions or related to these Terms and Conditions and their construction or their applicability, construction, infringement or discontinuance ("Disputes"), as well as any right to remedy or enforcement under relevant law, shall be resolved out of court by consultations and escalation at ANI's designated office(s) designated by ANI.

The arbitral proceedings shall be conducted by a single referee who shall be jointly designated by us and the User. The present Terms and Conditions are subject to and interpreted in accordance with the law of India. You and we hereby consent and commit that all disputes or claims resulting from or related to these Terms and Conditions shall be settled solely in a forum of jurisdiction in Bangalore, India.

Unless OLA has explicitly stated otherwise, the service is ONLY available for the OLA Mobil App and can be used for the taxis and does not apply to the black/yellow taxis (Kaali Peeli), Taxis for Sure. Taxis provided by third persons on the OLA portable platform ("OLA Platform") ("Services") are the sole property of the third person who provides the Service and all claim shall be against that third person ("Service Provider") who provides the Service to which the Service relates.

If you are excluded from using OLA's products and service during the period of the submission of the offer, you are excluded from participating in this offering. If OLA determines that the Client is carrying out deceptive activities in order to take advantage of the campaigns/offers or otherwise by using the Service, OLA retains the right to exclude any Client from the advantages of the campaigns/offers.

In no event shall OLA be liable for any damages whatsoever, whether in contract, tort, strict liability or otherwise, arising out of or in connection with the use or performance of this site, its service or any other information, whether in contract, tort, estoppel, strict liability or otherwise, whether in an action of contract, strict liability or otherwise. Quotation is subjected to the normal occurrences of higher power. At OLA's option, OLA may reject, decline, terminate, retract and end the offering at any point during the offering term without giving any reason and without giving advance notification to you. Except as provided above, these General Conditions of Offering, which will be incorporated into the Special Conditions of Offering, shall be construed in accordance with the law of India and the competent court in Bangalore, Karnataka has full and complete sovereignty.

In addition, you hereby acknowledge and consent to be bound by Zipcash's terms and conditions at all time.
